The Resource Conservation and Recovery Act (RCRA) was enacted in 1976 to address a problem of enormous magnitude--how to safely dispose of the huge volumes of municipal and industrial wastes generated nationwide. RCRA is the first major federal law controlling waste management in the United States. The RCRA legislation provides for State responsibilities while at the same time providing for uniform national standards to protect public health and welfare. The goals of RCRA were to:

  • To protect human health and the environment
  • To reduce waste and conserve energy and natural resources, and
  • To reduce or eliminate the generation of hazardous waste as expeditiously as possible.

The training requirements for RCRA personnel depend upon the classification of the facility (Large Quantity Generator (LQG), Small Quantity Generator (SQG), or Very Small Quantity Generator (VSQG)). According to 40 CFR 262.17(a)(7) Large Quantity Generator personnel must successfully complete a program of classroom instruction, online training (e.g., computer-based or electronic), or on-the-job training that teaches them to perform their duties in a way that ensures compliance with the hazardous waste regulations.

In addition to the initial RCRA training, 40 CFR 262.17(a)(7)(iii) requires LQG personnel to complete an annual refresher on RCRA.

The training requirements for SQGs are found in 40 CFR Part 262.16(b)(9)(iii). SQGs must ensure that their workers are:

"...thoroughly familiar with proper waste handling and emergency procedures relevant to their responsibilities during normal facility operations and emergencies"

The requirement for SQGs may require annual training or other type and frequency of training appropriate to the SQG facility.

RCRA &certification& is a term that is often used to refer to RCRA training. Training is required for hazardous waste personnel, and that training is dependent upon your job responsibilities and the classification of your facility (LQG, SQG, VSQG). It's up to your company to ensure you receive the appropriate RCRA training for your job.

Personnel who generate, handle, store, treat or dispose of hazardous waste may be required to complete a RCRA training course annually.

Training requirements relevant to hazardous waste generators signing manifests are specified by the Resource Conservation and Recovery Act (RCRA) Subtitle C and Department of Transportation (DOT) regulations. Federal RCRA regulations address training for generators in 40 CFR Part 262, depending on the generator's status. Hazardous waste generators are also "shippers" of hazardous materials and are subject to DOT's hazardous materials transportation regulations.
